Razas de canes potencialmente peligrosas y normas que la regulan en los países de Latinoamérica y El Caribe

Abstract

El objetivo del estudio fue evaluar y comparar las normas que regulan a las razas de canes potencialmente peligrosas en los países de Latinoamérica y El Caribe respecto a la normativa que la regula en el Perú. La información se obtuvo mediante la búsqueda bibliográfica sobre las normas, reglamentos y disposiciones que poseen los países de Latinoamérica y El Caribe respecto a la tenencia de perros potencialmente peligrosos. De esta manera, mediante cuadros de resumen se contrastan las coincidencias y discrepancias entre los diferentes componentes de las normas. Este estudio evaluó 16 normativas provenientes de 11 países de Latinoamérica y El Caribe. En cuanto a las características de los canes, Perú se centró más en las características de la raza, conducta y adiestramiento, dejando de lado las características anatómicas y la capacidad de generar lesiones. Por otro lado, se determinó que el American Pit Bull Terrier es la raza que se repite con mayor frecuencia; asimismo, se determinó que países como Perú, Argentina (B.A.), Chile, Colombia, Costa Rica, Ecuador, Guatemala y Uruguay, los tenedores se harán responsables frente a las lesiones ocasionadas por el can. En adición, las infracciones presentan multas que se pueden manifestar en salarios mínimos legales, Unidades Impositivas Tributarias o valor monetario y varía dependiendo de la gravedad que genera las lesiones. A pesar de que las normativas tienen un mismo enfoque sobre la tenencia responsable de canes considerados potencialmente peligrosos, existen diferencias que se deberían considerar en las normativas peruanas para que ésta sea más completa.

The objective of this study was to evaluate and compare the norms regarding the regulation of potentially dangerous dog breeds, in the area of Latin America and the Caribbean, and comparing it to the normative that is used in Peru. The information was gathered by a bibliographic search of the norms, regulations and provisions that Latin American and Caribbean countries have in place, regarding the ownership of potentially dangerous dog breeds. In this way, summary tables are used to compare the overlaps and discrepancies between the different components of the norms. This study evaluates 16 normatives of 11 Latin America and the Caribbean countries. Regarding the dogs characteristics, Peru was more focused on the breed, conduct and training, not focusing so much on the anatomical features and the capacity to provoque injuries. On the other hand, it was determined that the American Pit Bull Terrier is the most frequently repeated breed; it was also determined that in countries such as Peru, Argentina (B.A.), Chile, Colombia, Costa Rica, Ecuador, Guatemala and Uruguay, owners will be held responsible for injuries caused by the dog. In addition, infractions are subject to fines that can be expressed in legal minimum wages, Tax Units or monetary value and vary depending on the severity of the injury. Although the regulations have the same approach to the responsible ownership of dogs considered potentially dangerous, there are differences that should be considered in the Peruvian regulations, to make them more comprehensive.
