Violencia sexual a trabajadoras del hogar en Lima

Abstract

El presente estudio recoge las experiencias de violencia sexual sufridas por trabajadoras del hogar mayores de edad y en actividad, en la ciudad de Lima. Su finalidad fue explorar las condiciones que restringen el ejercicio de los derechos ciudadanos y sexuales de estas mujeres dentro del marco de los derechos humanos, en particular cuando enfrentan episodios de violencia sexual ejercida por algún(os) empleador(es). El estudio constituye una aproximación exploratoria, descriptivo-analítica a dichas experiencias. Se estudiaron siete casos seleccionados a través del muestreo por bola de nieve; la información se recogió por medio de entrevistas informales y de la técnica relato de vida. Los principales hallazgos indican que especialmente las características de la modalidad “cama-adentro” del servicio doméstico, vulneran a las trabajadoras del hogar –más aún si son menores de edad- y facilitan que los empleadores las sometan sexualmente a través del hostigamiento/ acoso y/o el abuso sexual. Frente a estos eventos, ellas tienden a proteger su integridad y su vida, muy difícilmente evidencian al agresor y no suelen pedir ayuda por temor a represalias y a que no les crean; sienten mucha vergüenza a ver expuesta su intimidad, siendo las consecuencias en su salud integral serias y profundas. Desconocen sus derechos y las leyes vigentes, y al darse estos eventos en el espacio privado de las familias para las cuales trabajan -y a pesar de contar con una legislación promulgada para normar el trabajo doméstico-, la protección del Estado respecto a los derechos laborales, además de los sexuales, reproductivos, humanos y del ejercicio de la ciudadanía de las trabajadoras del hogar, no siempre llega a concretarse. Paralelamente, ellas no logran visualizar al Estado como ente protector de sus derechos.

The present study refers to the experiences of sexual violence suffered by active domestic workers (adult women), in Lima City. Its purpose was to explore the restrictive conditions on the exercise of civic and sexual rights of these women inside the human rights field, mainly when they face episodes of sexual violence exercised by some employer(s). The study is an exploratory, descriptive-analytic approach to these experiences. Seven cases, selected through the snow ball sampling, were studied; the information was collected by means of informal interviews and the storytelling technique. The main results show that the characteristics of the "bed-inside" modality in domestic service, expose domestic workers –especially if they are under age- and facilitate that employers submit them sexually through harassment / pursuit, and/or sexual abuse. Once these events had occurred, they tend to protect their integrity and their life; they hardly put in evidence the aggressor and usually don’t ask for help fearing reprisals and not to be believed; they feel a lot of shame for exposing their intimacy, resulting all this in serious and deep consequences for their integral health. The domestic workers ignore their rights and the effective laws, and taken place these events inside the private space of the families for which they work -even with the existence of a legislation promulgated to norm the domestic work -, the State protection over the labour rights, as well as sexual, reproductive and human rights, and still with the exercise of the citizenship from the domestic workers, not always gets materialized. Parallelly, they are not able to visualize the State as a protective entity of their rights.
