Análisis comparativo de la aplicación de las decisiones andinas 706 y 721 en la obtención de notificaciones sanitarias obligatorias por laboratorios locales ante DIGESA y DIGEMID

Abstract

La Comunidad Andina de Naciones (CAN), entre sus objetivos, debe facilitar la integración regional, con miras a la formación gradual de un mercado común latinoamericano. En tal sentido, las Decisiones 706 y 721 son normas supranacionales que regulan a los Productos de Higiene Doméstica (PHD) a nivel de la región andina. Este trabajo tiene como objetivo general analizar de manera comparativa la aplicación de estas Decisiones en el Perú, donde se cuenta con dos Autoridades Sanitarias: la DIGEMID y la DIGESA, que autorizan la fabricación local a través del otorgamiento de Notificaciones Sanitarias Obligatorias (NSO). La metodología empleada será de tipo comparativa relacionada a la aplicación de esta Decisiones en cada Autoridad Sanitaria peruana. Se realizará una revisión documental de fuente primarias, se presentarán consultas técnicas a estas entidades para confrontar sus respuestas y se evaluará la viabilidad procedimental para obtener una NSO sin autorización sanitaria de funcionamiento. Como resultado esperado de este análisis comparativo, se busca demostrar que no se viene aplicando adecuadamente las Decisiones 706 y 721 en Perú, generando perjuicios a los administrados, que son los laboratorios locales que se dedican a la fabricación de Productos de Higiene Doméstica, de esta manera, se propondrá recomendaciones para homologar la aplicabilidad de estas Decisiones en el Perú.

The Andean Community of Nations, among its objectives (CAN), must facilitate regional integration, with a view to the gradual formation of a Latin American common market. In this regard, Decisions 706 and 721 are supranational regulations governing Household Hygiene Products (PHD) at the Andean regional level. This study aims to comparatively analyze the application of these Decisions in Peru, where two Health Authorities, DIGEMID and DIGESA, authorize local manufacturing through the granting of the Mandatory Health Notification (NSO). The methodology employed will be comparative, focusing on the application of these Decisions by each Peruvian Health Authority. A review of primary source documents will be conducted, technical inquiries will be submitted to these entities to compare their responses, and the procedural feasibility of obtaining an NSO without a valid operating health authorization will be evaluated. As an expected result of this comparative analysis, the aim is to demonstrate that Decisions 706 and 721 are not being properly applied in Peru, causing harm to the regulated entities, which are the local laboratories dedicated to the manufacture of Household Hygiene Products. In this way, recommendations will be proposed to standardize the applicability of these Decisions in Peru.
