El objetivo de este estudio fue comparar el contenido de la Ley Nro. 27596 “Ley que Regula el Régimen Jurídico de Canes” y la ley Nro. 30407 “Ley de Protección y Bienestar Animal” sobre el tema de la tenencia responsable de canes. De esta manera, mediante una matriz comparativa, evidenciar similitudes y diferencias que podían compartir entre ellas y evaluar sus fortalezas y debilidades. Ambas leyes proponen a las municipalidades locales a crear Ordenanzas Municipales que pongan en práctica la normativa y fomenten la tenencia responsable de canes. Así mismo, regularizan la eutanasia, mencionan la importancia de contar con albergues municipales y buscan fomentar la esterilización como plan de control de perros vagabundos. De la misma manera, ambas normativas presentan infracciones y sanciones, llegando hasta privaciones de libertad por incumplimiento de la norma. Además, se visualizó que la Ley 30407 propone el apoyo de entidades gubernamentales de manera multisectorial, criminaliza el abandono y abarca especies de animales que también conviven diariamente con los humanos, como los gatos, cuidando de esta manera que no sea un riesgo para la salud pública. A pesar de que entre ambas leyes existen casi 15 años de diferencia, se prevé la misma problemática de aplicabilidad de las normativas vigentes, debido al desconocimiento de las mismas por parte de la población y autoridades, disponibilidad de infraestructura y personal capacitado y recursos económicos destinados a cumplir con las exigencias de la normativa, probablemente debido a que la problemática asociada a la tenencia no responsable de los perros no está considerada en el mismo nivel de importancia que otros problemas sociales que puede afrontar el país, lo cual se ha de agudizar tras las secuelas producidas por la pandemia COVID-19.The objective of this study was to compare the content of Law No. 27596 “Law that Regulates the Legal Regime of Canines” and Law No. 30407 “Animal Protection and Welfare Law” on the subject of responsible canine ownership. In this way, through a comparative matrix, show similarities and differences that could be shared between them and evaluate their strengths and weaknesses. Both laws propose that local municipalities create Municipal Ordinances that put the regulations into practice and promote responsible canine ownership. Likewise, they regularize euthanasia, mention the importance of having municipal shelters and seek to promote sterilization as a control plan for stray dogs. In the same way, both regulations present infractions and sanctions, including up to deprivation of liberty for breach of the norm. Furthermore, it was visualized that law No. 30407 proposes the support of government entities in a multisectoral manner criminalizes abandonment and covers animal species that also live daily with humans, such as cats, thus taking care that it is not a risk for public health. Despite the fact that between the two laws there are almost 15 years of difference, the same problem of applicabiliy of the current regulations is foreseen, due to the lack of knowledge of them by the population and authorities, availability of infrastructure and trained personnel and financial resources destined to comply with the requirements of the regulations, probably due to the fact that the problem associated with the non-responsible possession of dogs is not considered to be of the same level of importance as other social problems that the country may face, which has to be exacerbated after the aftermath produced by the COVID-19 pandemic.
